The petitioner figured as an accused in Biraul P.S. Case No.280 of 2012, wherein offence punishable under Sections 365 and 366 of the Indian Penal Code was alleged. Apprehending arrest, the petitioner filed A.B.P. No.243 of 2012 in the court of the Sessions Judge, Darbhanga Camp Court at Benipur. The same was dismissed on 6.2.2013. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The allegation against the petitioner is serious in nature.

It is brought to the notice of this Court that one of the co-accused was granted regular bail by this Court. If that be so, the petitioner may also surrender and file an application for bail. Therefore, this application is dismissed, leaving it open to the petitioner to surrender before the court of S.D.J.M., Biraul at Benipur District- Darbhanga and move an application for bail. (L.
