The petitioner is in custody in connection with Laukaha (Lalmaniya) P.S. Case No. 31 of 2020 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 11.02.2020. He further submits that in the instant case total 450 litres of Nepali liquor was seized from a Sumo vehicle. He further submits that the petitioner is neither the owner of the vehicle nor concerned with the liquor and he was simply a passenger of said Sumo vehicle.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to

Patna High Court CR. MISC. No.18951 of 2020(2) dt.13-05-2020 2/2 be released on his personal bond to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Madhubani in connection with Laukaha (Lalmaniya) P.S. Case No. 31 of 2020, due to the circumstance of total lock down on account of pandemic Covid-19.
