JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 413,414/34 of the Indian Penal Code.

As per the prosecution case, apprehended co-accused Sonu Kumar from whose possession stolen motorcycle was recovered, took name of the petitioner as his associate who used to commit theft of motorcycle.

No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner's name has figured during course of investigation in confessional statement of co-accused.

Learned counsel for the State opposes the prayer for bail. He submits that the petitioner has got criminal antecedent

Considering the fact that the petitioner has got criminal antecedent of similar nature, prayer for bail of the petitioner is rejected.
