JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-05-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Narpatganj Police Station Case No. 429 of 2016, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against these petitioners and no specific overt act is attributed to them. In fact, there is enmity between the informant and co-accused, Kamal Kishore Singh on account of land dispute. These petitioners have no

Patna High Court Cr.Misc. No.11492 of 2017 (3) dt.17-05-2017 concern with the alleged piece of land as well as affairs between the Kamal Kishor Singh. Hence, the petitioners deserve the privilege of anticipatory bail.

Learned A.P.P. for the State has opposed the prayer for bail and submitted that petitioners are named in the F.I.R. and there is allegation against these petitioners that they have committed murder of Nand Kishore Singh, father of the informant.

Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail of these petitioners. Accordingly, the prayer for anticipatory bail of this petitioners is, hereby rejected. (Arvind Srivastava, J.) brajesh/- U T
