JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nadi P.S. Case No. 44 of 2018 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Allegation against the petitioner, who happens to be father-in-law of the deceased, is of causing death of the deceased and throwing her dead body in the river of Ganges. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and there is general and omnibus allegation and considering the same other co-accused persons have been granted anticipatory bail by co-ordinate Bench of this Court vide order dated 19.11.2018 passed in Cr.Misc.No. 61392 of 2018 and vide order dated 23.1.2019 passed in Cr.Misc.No.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna, in connection with Nadi P.S.Case No. 44 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
