Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 379, 411 of the IPC, registered in connection with Buxar (Town) P.S. Case No.452 of 2018. As per allegation, when the informant returned from the ticket counter of railway station he did not find his motorcycle. He has mentioned in the FIR that some unknown miscreants had taken away his motorcycle.

Learned counsel for the petitioner has submitted that petitioner was not arrested on the spot, nothing was recovered from his possession and his name has been figured in the

Patna High Court CR. MISC. No.30135 of 2021(2) dt.11-03-2022 2/2 confessional statement of the co-accused, Deepak Kumar. He has submitted further that the petitioner is a person of clean antecedent and the name of the petitioner has been given in the present case at the instance of his neighbourer who is a criminal. Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let the petitioner above named, in the event of his arrest or surrender within three weeks from the date of communication of this order be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No.452 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Office shall ensure that all the defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
