JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-47(A) of the Excise Act.

Thirty eight bottles containing 750 ml. each Indian made foreign liquor are said to have been recovered from a bus and the petitioner was found sleeping on the seat from where, the recovery was made.

Submission on behalf of petitioner is that the petitioner is languishing in jail custody since 31-07-2016 and as a matter of fact, he was bona fide passenger but on the basis of suspicion, he was arrested by the police.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.45964 of 2016 (2) dt.21-10-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with G.O.
