The petitioner has sought modification of the order dated 03.03. 2017 passed in Cr.Misc.No.7110 of 2017, by which on the joint submissions made by the petitioner and the counsel for the complainant that they were ready to stay together, the petitioner was granted anticipatory bail and was directed to surrender before the court below within a period of six weeks. The counsel for the petitioner submits that in spite of petitioner's best efforts to take the complainant along with him, the complainant did not agree to stay with him and for the same reason the court below did not accept the bail bond furnished on behalf of the petitioner.

Naimul Haque Ansari @ Naimul Haque Ansari vs. The State of Bihar reported in 2006(3) PLJR 182. Counsel for the informant is present. He submits that the informant is ready to stay with the petitioner. Considering the aforesaid facts and circumstances, the petitioner is granted further six weeks time from today to surrender and furnish bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna City, Patna in connection with Complaint Case No.184 of 2015.

Even the court below finds that the complainant is not agreeable to accompany the petitioner, the bail bond of the petitioner shall be accepted by the court below. With the aforesaid observations, the modification application stands disposed of.
