The petitioners seek bail in Bhairav Asthan P.S.Case No. 87 of 2018, registered for the offence punishable under Sections 394, 307, 328 and 397of the Indian Penal Code. The informant claims to be the driver of a Bolero vehicle, which is used on hire. Allegedly, the FIR named accused persons came and hired the vehicle and while on way to some place they attempted to snatch the vehicle after making the informant drink some intoxicant. On the informant's protest, local people came whreafter the accused persons were apprehended.

Learned counsel, appearing on behalf of the

Patna High Court Cr.Misc. No.62120 of 2018(2) dt.08-10-2018 2/2 petitioners, contends that the petitioners were not apprehended by the police, rather they and other accused persons were taken to the police by the private persons. He further contends that the petitioners have been maliciously implicated in the criminal case with ulterior motive.

Considering the submission that the petitioners were apprehended by the local people and thereafter were handed over to the police, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned A.C.J.M.- I, Jhanjharpur, Madhubani in Bhairav Asthan P.S. Case No. 87 of 2018.
