Learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual Court proceedings with the aid of audio visual technology.

Heard learned counsel for the petitioner, informant and the learned APP for the State.

Petitioner seeks bail in a case registered under Sections 420, 376 of Indian Penal Code.

Allegation is that on alluring the informant for

Patna High Court CR. MISC. No.18250 of 2020(4) dt.03-07-2020 2/3 marriage, the petitioner has been establishing physical relationship with her repeatedly and has finally not only refused to marry her, but has also posted some obscene pictures on the Facebook.

It is submitted by petitioner's counsel that the prime reason for lodgement of the case was that the informant desired to marry the petitioner which has subsequently been agreed upon between the parties. In light of such agreement, a joint compromise petition has also been filed before the Court below, copy of which has been placed on record in the instant proceedings.

The learned counsel for the informant also submits, after instructions, that the parties have now compromised the issue and they are willing and ready to enter into matrimonial relationship.

Considering the aforesaid, let the petitioner, above named, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Muzaffarpur in connection with Bochahan PS Case No 276 of 2017 subject to the following conditions:- (i) That one of the bailors will be a close relative of the

Patna High Court CR. MISC. No.18250 of 2020(4) dt.03-07-2020 3/3 petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
