JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-05-2017 Heard learned counsel, Mr. Abhishek Kumar, for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kessariya Police Station Case No. 190 of 2016, disclosing offences under Sections 382, 34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner has not been named in the F.I.R. and merely on the basis of confession, the petitioner has been made accused in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner, who is of clean antecedent, has no concern with the alleged recovery. Hence, the petitioner deserves the privilege of anticipatory bail.
