The petitioner seeks bail in Hathidah P.S. Case No.53 of 2017 registered for the offence under Sections 392 of the I.P.C. The F.I.R. of the occurrence of robbery is against unknown.

Submission on behalf of the petitioner is that on the basis of the written report of the informant Manoj Kumar F.I.R. was instituted under Section 392 of I.P.C. against unknown on 3.9.2017. In course of investigation his name transpired on the basis of confessional statement of co-accused, Irfan Ali. Nothing has been recovered from the possession of the petitioner. While the informant has claimed to identify the miscreants but the petitioner has not been put on Test Identification Parade.

Patna High Court Cr.Misc. No.62365 of 2018 (2) dt.06-10-2018 2/2 Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., IV,Barh, in Hathidah P.S. Case No.53/17.
