JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.859 (C) of 2010, disclosing offence under Section 498A of the Indian Penal Code. Allegation against the petitioner is of subjecting the opposite party no.2, complainant with respect to demand of dowry.

Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. He is still ready to keep her with full dignity and care.

On the other hand, learned counsel appearing on behalf of the opposite party no.2 has opposed the prayer for bail on the ground that she was subjected to assault and as such, she

Having heard both sides, in view of the above facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Patna, in connection with Complaint Case No.859 (C) of 2010, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to condition that if any, maintenance case is being filed by the opposite party no.2, he is to appear and co-operate in disposal of the same and abide by any interim order or final order passed by the learned trial court. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
