JUSTICE ALOK KUMAR SINHA ORAL ORDER 02-04-2025 In the writ application, the petitioner has prayed for the grant of following reliefs:- (i) For a direction upon the respondent to consider the case of the petitioner for grant of 1st and 2nd Assured Career Progression and 3rd MACP in the light of order dated 28.06.2024 passed in C.W.J.C. No. 18727 of 2017 (Kamlanand Thakur vs. The State of Bihar and others).

(ii) For consideration of the Representation of the Petitioner as contained in Annexure-4 in the light of letter dated

Patna High Court CWJC No.5005 of 2025(2) dt.02-04-2025 2/3 27.02.2025 as contained in Annexure-3, whereby the issue of 1st ACP in the Pay Scale of Rs. 6500-10500, 2nd ACP in Pay Scale of Rs. 10000-15200 and 3rd MACP has been settled in the light of order passed by Hon'ble Apex Court in S.L.P. No. 82198226/2019 (Amresh Kumar Sinha vs. State of Bihar and others) has been settled and a Notification to this effect dated 27.02.2025 has been issued.

(iii) Any other order/orders for which the petitioner is found entitled to in the facts and circumstances of the case.

2. During the course of hearing, it transpires that the petitioner has filed a representation dated 02.03.2025 (Annexure-P/5) for claiming the same reliefs before the Chief Engineer, Water Resources Department, Motihari, East Champaran (respondent no. 4) which is pending till date.

3. With the consent of parties, the Chief Engineer, Water Resources Department, Motihari, East Champaran (respondent no. 4) is directed to dispose of the representation dated 02.03.2025 filed by the petitioner within two months from today after giving an opportunity of hearing to the petitioner. The order passed by the respondent no. 4 should be a reasoned and speaking order.
