JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420/467/468/471/120B of the Indian Penal Code.

It is alleged that the petitioner obtained appointment on the post of Siksha Mitra, on the basis of forged educational certificates.

Learned counsel for the petitioner submits that without proper verification and enquiry, petitioner's certificates have been declared to be forged and fabricated. Moreover, as soon as the petitioner got knowledge that his certificates are not genuine, he sent resignation on 1.6.2023 (annexure 3 to the supplementary affidavit) through speed post to the Block Education Officer, Sono, Jamui.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.23507 of 2023(3) dt.03-07-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Jamui in Sono Police Station Case No. 203 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
