The petitioner seeks bail in Sonbarsa P.S. Case No. 38 of 2019, instituted for the offence under Section(s) 414 of the Indian Penal Code and Sections 11 (i) 11 (h) of Prevention to Animal Cruelty Act.

It is alleged in the written report that petitioner was found coming from Nepal with some animals. He came inside the India and when he was told by the informant to stop, he tried to run away after leaving the cattle. He was caught hold by the informant after chase. It is further alleged that 13 cows and one calf were recovered. On query, petitioner has not given any explanation about the same.

Counsel for the petitioner submits that petitioner has

Patna High Court CR. MISC. No.19573 of 2019(2) dt.01-04-2019 2/2 purchased those cattle from Ishwarpur Nagarpalika, Pashu Bazar (Annexure-2).

Petitioner is in custody since 29.1.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sonbarsa P.S.
