2. The petitioner is apprehending arrest in connection with Amarpur P.S. Case No. 338/2023 registered on 14.05.2023 for the offences punishable under Sections of the Indian Penal Code.
3. As per prosecution, the FIR has been lodged against 8-10 unknown accused persons with an allegation of resorting fire upon the informant and one Kashi Tanti causing bullet injury to them.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no office. In fact, the FIR has been lodged against unknown, but
Patna High Court CR. MISC. No.23847 of 2024(3) dt.10-05-2024 2/2 subsequently, on the basis of confessional statement of coaccused, the name of the petitioner has figured in this case. There is no eye witness to the said occurrence and the antecedent of the petitioner is clean.
5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka, in connection with Amarpur P.S. Case No. 338/2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
