Petitioner, who is in custody, seeks bail in connection with S. Tr. No. 103 of 2018 arising out of Janki Nagar P.S. Case No. 188 of 2017 registered for the offences punishable under Sections 366A, 504 and 506/34 of the Indian Penal Code.
Allegation against petitioner is of kidnapping the daughter of the informant with an intention of marriage and threatening the informant with dire consequences. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to enmity. Daughter of the informant has gone with her own consent with another unknown
Patna High Court Cr.Misc. No.63716 of 2018(2) dt.29-10-2018 2/2 boy for the purpose of marriage. He has no criminal antecedent. He is in custody since 12.12.0217. The date of occurrence is 02.10.2017 but FIR was instituted after delay of one month i.e. 01.11.2017.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, 1st , Purnea in connection with S.T. No. 103 of 2018 arising out of Janki Nagar P.S. Case No. 188 of 2017.
