Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code.

Prosecution case is that a dispute of flowing the drainage water the accused persons including the petitioner assaulted the informant. When the father of the informant came to rescue, then he was assaulted by the petitioner with the back of axe on his head. The injury has been found to be marginal size on head, but the opinion has been kept reserved. There is counter version of the occurrence. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.37283 of 2015 (2) dt.15-09-2015 consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Mirganj P.S. Case No. 93 of 2015, pending in the court of learned Chief Judicial Magistrate, Gopalganj.

With this observation this application is disposed of.
