The petitioner seeks bail in a case registered for offences punishable under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 40 litres country made liquor was recovered from the Scooty of the petitioner It is further contended that nothing was recovered from the possession of the petitioner and he has falsely been implicated in this case only on suspicion and due to dirty village politics. Petitioner claims that he is having clean antecedent and is in custody since 08.08.2018.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.62717 of 2018(2) dt.08-10-2018 2/2 the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-2, Banka in connection with Dhoraiya P.S. Case No. 160/18 with a condition that one of the bailors must be belonging to the State of Bihar.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
