JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-06-2020 Heard Mr. Ranjan Kumar Jha, learned counsel for the petitioner, Mr. Dashrath Mehta, learned Additional P.P. and Mr. Santosh Kumar Sinha, learned counsel appearing on behalf of the informant through video conferencing.

The petitioner seeks bail in Shambhuganj P.S. Case No.76 of 2019, registered under Sections 341, 323, 354, 354(c), 354(d), 504, 506 and 34 of the Indian Penal Code and under Section 8 of the POCSO Act.

The gist of the allegation is that Deepak Singh teased the niece of the informant. Pankaj Singh and Chandan Singh, the petitioner, are alleged to have assisted and abetted Deepak Singh. Deepak Singh had earlier kidnapped the niece of the informant for the purpose of marriage.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.19897 of 2020(2) dt.24-06-2020 2/2 petitioner did not even touch the body of the victim. The petitioner is in jail since 24.01.2020. Kanhaiya Singh has already been enlarged on bail.

The learned Additional P.P. as well as the learned counsel for the informant submit that the petitioner is abetter and instigator.

Having considered the facts that the petitioner is alleged to have abetted Deepak Singh but the petitioner did not even touch the body of the victim for that the petitioner is in jail since 24.01.2020, petitioner, namely, Chandan Singh is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-I-cum-Special Judge, Banka in connection with Shambhuganj P.S.
