JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Spl. Case No. 11/2020, arising out of R.C. No. 10/A/2018, registered for the offence punishable under Sections 34/120B/409/420/467/468/471 of the Indian Penal Code and Sections 13(2) r/w (1) (c) and (d) of PC Act, 1988. Learned counsel for the petitioner submits that the petitioner has been arrested after completion of investigation and after submission of chargesheet. During investigation, petitioner had cooperated with the investigation. Petitioner is in custody since 11.10.2022.

Patna High Court CR. MISC. No.23448 of 2023(2) dt.22-05-2023 2/2 Investigation submitted that the petitioner is involved in one criminal antecedent and during investigation para 16 of the chargesheet, material has come against the petitioner. Considering the submission of parties, in view of the law laid down by the Hon'ble Supreme Court in the case of Satendra Kumar Antil Vs. C.B.I. (2022) 10 SCC 51 and considering the fact that petitioner had cooperated during investigation and he was not arrested by the C.B.I., this application is allowed.
Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, C.B.I.-II, Patna in connection with Spl. Case No. 11/2020, arising out of R.C. No. 10/A/2018.
