The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 386/34 of the Indian Penal Code.
The prosecution case is that the miscreants used to demand extortion through mobile. The informant after informing the police took one lakh rupees with him to handover the same to miscreants. In the meantime, the people from the informant side caught hold one of the accused when police also reached on the spot. The apprehended accused disclosed his name as Sabin Panjiyar whereas disclosed
Patna High Court Cr.Misc. No.38221 of 2015 (2) dt.22-09-2015 2/2 the name of escaped accused as Prabhakar Yadav and the petitioner.
It is submitted by learned counsel for the petitioner that except the confession of the apprehended accused there is nothing against the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Mahishi P.S. Case No. 88 of 2015 pending in the court of learned Chief Judicial Magistrate, Saharsa.
With the aforesaid observation, this application is disposed of.
