JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This application, for grant of anticipatory bail, arises out of Rupaspur P.S. Case No. 162 of 2018 (Special Case No. 40 (A) of 2018), disclosing offences under Sections 395, 397 and 412 of the Indian Penal Code and Section 25 (1-b)a, 26 and 35 of the Arms Act.

Prosecution case is that police on informant that some miscreants are planning to commit dacoity raided the place and arrested some miscreants armed with pistols and they named other accused persons including the petitioner as their associates..

Submission of learned counsel for the petitioner is that except confessional statement of co-accused, there is absolutely nothing against the petitioner and after this case, petitioner has been made accused in two more cases.

Having heard both sides, considering the facts and circumstances as well as the fact that petitioner is an accused in two more cases of similar nature, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the materials available on record, without being prejudiced by this order.

This application is, accordingly, dismissed.
