The petitioner filed this petition for modification of order Dated 12.12.2014 passed in Cr. Misc. No. 29582/2014. It is submitted that vide Annex ure-1 at page 9, the case between the husband and the wife was compromised. The order was passed directing the petitioner to pay Rs. 15,00/- to his wife each and every month as maintenance.
It appears that the order of compromise was passed on 06.12.2014 in Lok-Adalat and there is nothing on record to show that the petitioner was not to pay any maintenance to his wife and a son, who is living with his wife. The order directing the petitioner to pay Rs. 15,00/- was passed on 12.12.2014 and the
Patna High Court Cr.Misc. No.38060 of 2015 (3) dt.14-12-2015 order dated 06.12.2014 was brought to notice of the court. Considering the facts aforesaid that after compromise the present order is passed, I do not find any reason to modify the order dated 12.12.2014 passed in Cr. Misc. No. 29582/2014. Accordingly, the petition for modification of the aforesaid order is dismissed.
