JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 26-10-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his application for bail in connection with Sessions Trial No. 118 of 2014 arising out of Panapur P.S. Case No. 99 of 2012 registered under Sections 307, 353, 511, 120/34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 23.09.2014 passed in Cr. Misc. No. 33783 of 2014.

In compliance with the earlier order dated 05.10.2016 passed by this Court, the trial court has submitted its

Patna High Court Cr.Misc. No.41560 of 2016 (3) dt.26-10-2016 2 / 2 report, from perusal of which, it would be evident that out of eight prosecution witnesses, six have already been examined and the case is pending before the trial court for examination of the remaining two witnesses.

Considering the stage of the case and the likelihood of the trial coming to an end in near future, I am not inclined to take a different view of the matter. The application for bail is rejected, once again, with liberty to the petitioner that if the trial is not concluded within four months from the date of receipt/production of a copy of the order, the petitioner may move for bail before the trial court itself.
