This application for regular bail arises out of Basopatti P.S. Case No. 7 of 2020, disclosing offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act 2016. It is alleged in the F.I.R. that the petitioner and another co-accused were found carrying illicit Nepali wine on two separate bicycles. Noticing presence of the police, they attempted to flee away. They were, however, apprehended by the police. From the petitioner's possession, 72 litres of Nepali wine was allegedly recovered.
Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has no criminal antecedent and
Patna High Court CR. MISC. No.18301 of 2020(3) dt.24-06-2020 2/2 he is in custody since the date of the lodging of the F.I.R. Considering the aforesaid submission, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Basopatti P.S. Case No. 7 of 2020.
