The petitioner seeks bail in Barbigha P.S. Case No. 45 of 2013, registered for the offence punishable under Sections 395, 397 of the Indian Penal Code.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner transpired in this case on the basis of tower location of mobile of petitioner near the place of occurrence on the alleged date of occurrence. No incriminating article has been recovered from possession of this petitioner. No test identification parade has been held till date. Petitioner is in custody since 30.01.2022.
