JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Sadar Muzaffarpur P.S. Case No. 557 of 2015 for the offences punishable under sections 212, 216, 399, 402 and 414 of the I.P.C, Sections 25 (1-b) a, 26 and 35 of the Arms Act and sections 20 and 22 of the N.D.P.S. Act.
Allegedly, seven accused persons were apprehended by the police and some succeeded in fleeing away and after search country made pistol, cartridges and at that place in a bag 1⁄2 kg.
Patna High Court Cr.Misc. No.10940 of 2017 (2) dt.18-03-2017 2/3 ganja were recovered and Mayank Kumar was apprehended who stated the names of the petitioners that in their houses Mithilesh Kumar and Amit Kumar used to stay and they also used to stay there and further Mithilesh Kumar and Amit Kumar used to give money, which they realized by way of ransom, to the petitioners and the petitioners invest the same in the business. Submission is of false implication and that the petitioners are running agency of Britannia Company, they have got no criminal antecedents, Mayank Kumar being inimical to the petitioners has stated the names of the petitioners falsely, besides the confessional statement of Mayank Kumar there is no other material against the petitioners and as such the petitioners deserve sympathetic consideration.
The learned A.P.P. submits that the name of the petitioners was taken by Mayank Kumar who was apprehended by the police and the petitioners used to invest the ransom money in the business.
In the facts and circumstances as stated above, considering that the names of the petitioners have come in the confessional statement of co-accused made before the police and further the petitioners have got no criminal antecedents and as such the petitioners, in case of their arrest or surrender within four
Patna High Court Cr.Misc. No.10940 of 2017 (2) dt.18-03-2017 3/3 weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. the court of Sessions Judge- Cum- Special Judge, Muzaffarpur in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
