Mr. Sanjay Kumar Sharma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-04-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 303(2), 76, 109, 352, 351(3) and 3(5) of the B.N.S..
3. As per prosecution case, informant, namely Rita Devi, alleged that on 04.11.2024 at about 7 AM, while his son was going to market along with his uncle, in the meantime, all the F.I.R. named accused persons, including these petitioners,
Patna High Court CR. MISC. No.21057 of 2025(2) dt.29-04-2025 2/3 intercepted the bike and assaulted them. Thereafter, when informant and her family members went to save him, they were also assaulted. It is further alleged that the accused persons also snatched gold chain and money and attempted to disrobe the informant.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. There are general and omnibus allegations and there is no specific accusation of the overt act against these petitioners. These petitioners are not authors of the injuries sustained by Bablu Kumar. There is case and countercase between the parties.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the general and omnibus nature of accusation and case and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like
