====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Gurua P. S. Case No. 87 of 2019 registered for the offences punishable under Sections 126(2), 115(2), 118, 109(1), 303(2), 302, 120B/34 of the Indian Penal Code.
3. As per prosecution case, on 14.05.2019 at about 7 PM, brother of the informant had gone to attend a marriage ceremony where this petitioner along with other F.I.R. named accused persons fired upon him as a result of which brother of the informant died on the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Similarly
Patna High Court CR. MISC. No.19818 of 2026(3) dt.17-07-2026 2/2 situated co-accused, namely, Mukesh Kumar @ Mukesh Yadav having similar allegation, has already been granted regular bail by co-ordinate Bench of this Hon'ble Court vide order dated 01.11.2021 passed in Cr. Misc. No. 32557 of 2021. Petitioner claims clean antecedent and is in custody since 03.02.2026. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the fact that similarly situated coaccused has already been granted regular bail, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Gurua P.
