The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307 and 504 of the Indian Penal Code. The accusation is of making assault to the informant.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and no substantial injury has been caused to the informant. Though, statement to that effect has not been made in the petition. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.37276 of 2015 (2) dt.14-09-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory provisionally for two months bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Fatehpur P.S. Case No. 03 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail will be confirmed by the learned court below, if it is found that the informant has not received any grievous injury, but if it is found that the informant has received grievous injury then the petitioner will surrender and pray for regular bail.
