JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-07-2024 The present writ petition has been filed seeking the following relief:- "1. That the present writ application has been filed for the direction to the respondent authorities to reconstruct the house of the petitioners, which has been demolished part area of construction of dwelling house on 18.11.2022 of the petitioners respectively which have been constructed upon amalgamated part area of land of Plot No. 739 & 740 bearing Khata No. 24 situated under Mauza: Sihar, P.S: Jagdishpur, District: Bhojpur just adjacent to south of Plot No. 738 which is the public road in pursuance to notice dated 10.11.2022, issued by Respondent

Patna High Court CWJC No.4732 of 2023(6) dt.30-07-2024 2/2 No. 2 u/s 5(2) of the Bihar Public Land Encroachment Act."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the District Magistrate, Bhojpur at Ara, by filing appropriate representation, annexing all the proof regarding their right, title and interest over the land / dwelling houses in question, within a period of two weeks from today. Liberty, so sought, is granted. 3.

It is needless to state that in case, appropriate petition is filed by the petitioners, within a period of two weeks from today, before the Collector, Bhojpur at Ara, he shall make appropriate enquiry into the matter and pass a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
