2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Supaul P.S. Case no. 346 of 2023 instituted for the offence under Sections 302, 304(B), 120(B)/34 of the IPC.

3. Allegation against the petitioners is of killing of the daughter of the informant due to non-fulfillment of dowry demand.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The petitioners are paternal uncle and aunt of the deceased due to which they have falsely been implicated in the present case. The petitioners have no concern mess and business of the deceased

It is further submitted that the husband of the petitioner is already in custody upon whom, it was his responsibility to keep his wife well. Similarly situated other co-accused who are in-laws of deceased, have been granted bail by a co-ordinate Bench of this court vide order dt. 4.4.2024 in Cr. Misc. No. 22354 of 2024.

5. Learned APP appearing for the state has opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Supaul P.S. Case no. 346 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Supaul subject to the conditions as laid down under section 438(2) of the Cr.P.C.
