2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
4. As per the prosecution case, 5 litres of illicit country made mahua liquor as well as 5 quintals of jawa mahua has been recovered from the bush.
5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Nothing incriminating has been recovered from the conscious
Patna High Court CR. MISC. No.21887 of 2025(3) dt.28-07-2025 2/2 possession of the petitioner. Name of petitioner transpired in the present case on the basis of disclosure made by local people. Petitioner has no concern with the alleged recovery.
6. Learned APP for the State has opposed the bail petition and submits that petitioner carries eight criminal antecedents out of which five are of similar nature.
7. Considering the fact that petitioner carries eight criminal antecedents out of which five are of similar nature as mentioned in paragraph no. 3 of the bail petition as well as in the supplementary affidavit, the prayer for anticipatory bail of petitioner is rejected.
