JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 This is an application for grant of bail for offences punishable under Section 379 of the Indian Penal Code. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R. On the basis of confessional statement before the police he has been made accused in the present case. Except suspicion there is no other evidence against him. No stolen article has been recovered from his possession. He is in custody since 12.4.2016.

Having heard both the parties and in view of the fact that only on the basis of confessional statement he has been made accused and he is in custody since 12.4.2016, let above named

Patna High Court Cr.Misc. No.49985 of 2016 (3) dt.10-01-2017 2/2 petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar at Motihari, in connection with Trial no. 2005 of 2016 arising out of Rajepur P.S. Case no. 11 of 2016 with condition that he shall co-operate during the trial and appear before the court on each and every date fixed by it. If petitioner fails to appear on two consecutive dates without proper and reasonable cause, his bail bond shall be liable to be cancelled. (Vinod Kumar Sinha, J) sudip/- U T
