JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with Sessions Trial No. 258/2018 arising out of Chainpur P.S. Case No. 151 of 2018, registered for offences punishable under Section 302 of the Indian Penal Code.

Allegation against the petitioner is of causing death of his wife.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and as a matter of fact the deceased was completely under the influence of Tantrik, for which, she used to visit to Tantrik and due to which, the villagers badly assaulted her and when the petitioner went to save her, he was falsely been made accused in this case. Learned counsel for the State drawing the attention of this Court towards paragraph - 7 and 8 of the case diary has

Patna High Court CR. MISC. No.18431 of 2019(4) dt.21-05-2019 2/2 submitted that the witnesses have stated that they had seen one person assaulting a women on her head and they have caught the person and handed over him to the police.Later on the lady was declared dead.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.

This application is, accordingly, dismissed.
