JUSTICE SUDHIR SINGH ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363,366 and 366A/34 of the I.P.C. Accusation is that the informant's niece was kidnapped by the accused persons including the petitioner with bad intention for illegal relationship.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.3.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has been recovered. Her statement has been recorded under Section 164 of the Cr.P.C. No overt act has been alleged against the petitioner.

Patna High Court Cr.Misc. No.35313 of 2016 (3) dt.21-10-2016 2/2 Specific allegation has been made against co-accused Md. Mukhtar.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge XI-cum-A.C.J.M.-X, Hajipur at Vaishali in connection with Patepur P.S. case No.175 of 2014.
