Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 366 and 366(A)/34 of the Indian Penal Code, registered in connection with Saraiya P.S.Case No.571 of 2018.

As per allegation, the accused persons had kidnapped the victim.

The learned counsel for the petitioner has submitted that the alleged victim filed an affidavit on 10.12.2018, stating therein that she has solemnized her marriage with Mitranjan Kumar as her former husband Pankaj Jha was inflicting atrocities on her in drunken condition. He has submitted further that considering the above mentioned facts co-accused

Patna High Court CR. MISC. No.31787 of 2021(2) dt.21-03-2022 2/2 Dharmendra Paswan was granted anticipatory bail by a coordinate Bench of this Court, vide order dated 01.05.2019 in Cr. Misc. No. 19851 of 2019.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Muzaffarpur in connection with Saraiya P.S.Case No. 571 of 2018, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
