Petitioner is in custody in connection with Suppi P.S. Case No. 03 of 2019 for the offence under sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case approximately 45 liters of liquor was seized.

Learned counsel submits that liquor was not seized from the conscious possession of the petitioner. The petitioner is in custody since 16.2.2019. Considering the fact that petitioner has no criminal
