1. Heard the parties.

2. The petitioner has been working as Assistant Teacher in Govt. Kasturba Gandhi Middle School Khagaul, AnchalDanapur, District-Patna. She has filed the writ application for a direction to the respondents to grant graduate trained pay scale and the scale of Headmaster from the due date of her entitlement as per Bihar Nationalized Elementary Teacher Promotion Rules 1993 and in the light of the order passed by this court in the case of Raghwendra Sharma & Ors. versus State of Bihar & Ors. vide CWJC No. 15610 of 2018.

3. Learned counsel for the State submits that the petitioner has already filed representations (Annexure: P-15 series) under the rules before the Regional Deputy Director of Education, Patna Division, Patna which is pending.

4. Having considered the submission of the respondent / state and taking into consideration the fact that representations filed by the petitioner is pending before the RDDE, Patna Division, Patna; this writ application is disposed with direction to the RDDE, Patna Division, Patna to dispose the representations filed by the petitioner within a period of three months from the date of receipt / production of a copy of this order.

5. It is made clear that if the petitioner is found entitled for

Patna High Court CWJC No.6462 of 2025(2) dt.22-04-2025 3/3 the graduate trained pay scale and the scale of Headmaster, the same shall be paid to her within a period of two months from the date of disposal of the representations.

6. With the aforesaid observation and direction, the application is disposed of.
