JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-b)A/26(i)(ii)/35 of the Arms Act. One pistol is said to have been recovered from conscious possession of the petitioner whereas; several fire-arms were recovered from possession of other accused. It is alleged that the petitioner and other accused had assembled to make a deal of sale and purchase of fire-arms.

The petitioner is languishing in jail custody since 0805-2016. No doubt, petitioner was made accused in two cases of Arms Act but submission on behalf of the petitioner is that the investigation against the petitioner has already been completed

Patna High Court Cr.Misc. No.46754 of 2016 (2) dt.25-10-2016 2/2 and having more or less similar allegation, co-accused Jugnoo Dixit has already been granted privilege of bail. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jamalpur P.S. Case No. 59 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Munger.
