2. The petitioner is apprehending arrest in connection with Nanpur P.S. Case No. 197 of 2024, registered on 01.05.2024, for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against ten named accused persons, including the petitioner, alleging that they assaulted the informant's sons after a chase.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that, from a bare perusal of the FIR, it is apparent that the dispute arose over a trivial matter, which led to the lodging of a case and a counter-case. The informant's side
Patna High Court CR. MISC. No.19419 of 2025(2) dt.16-04-2025 2/2 has lodged Nanpur P.S. Case No. 197 of 2024, while the petitioner's side has lodged Nanpur P.S. Case No. 196 of 2024. Counsel further submits that one similarly situated person has already been granted bail by a co-ordinate Bench of this Court vide order dated 15.02.2025, passed in Cr. Misc. No. 5811 of 2025. Counsel also submits that criminal antecedent of the petitioner is not clean, there is one criminal case pending against him.
5. Learned APP for the State opposes the prayer for bail and submits that antecedent of the petitioner is not clean.
6. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Pupri, Sitamarhi, in connection with Nanpur P.S. Case No. 197 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J.) Aman Kumar/- U T
