In the present case, the petitioner is seeking bail in Katihar Nagar P.S. Case No. 848 of 2019 registered for the offence punishable under Section 30 (a) read with Section 13 of Bihar Prohibition & Excise Act, 2016.

The allegation has been made that about 66 liters of illegal liquor was recovered from the motorcycle and the police has arrested the petitioner as he was found involved in illegal trading, however, counsel for the petitioner submits that he is in judicial custody since 17.02.2020. In paragraph 3, it is stated that the petitioner has also a criminal history of the same nature. Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.19185 of 2020(2) dt.10-06-2020 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Katihar in connection with Katihar Nagar P.S. Case No. 848 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court/prosecution would be at liberty to take steps for cancellation of his bail bonds.
