JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 307, 504, 506, 324/34 of the Indian Penal Code .

Petitioner and other F.I.R named accused are said to have opened fire causing firearm injury to the informant and one Mukesh Kumar but neither injury report of informant nor injured Mukesh Kumar could be brought on record by the prosecution. Petitioner does not have any criminal antecedent. Taking note of this fact that no specific overt act has been attributed against the petitioner and the allegation of firing is general in nature and according to the informant

Patna High Court CR. MISC. No.20583 of 2020(3) dt.05-10-2020 2/2 himself, he sustained only one firearm injury, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Danapur, Patna in connection with Digha P.S. Case No. 197 of 2019.
