The petitioners apprehend their arrest in Forbisganj (Simraha) P.S. Case No. 373 of 2015 instituted for the offence under Section (s) 147, 148, 149, 341, 342, 323, 325, 427, 337, 338, 435, 436, 380 of the Indian Penal Code. It is alleged in the written report that a mob of about 200-250 people after forming unlawful assembly surrounded the meat factory of the informant, damaged the meat factory and looted the articles of the shop worth Rs. 5,00,000/-. It has been submitted on behalf of the petitioners that petitioners are not named in the written report.
Patna High Court Cr.Misc. No.13335 of 2017 (3) dt.30-03-2017 2/2 The case diary has been received. After going through the case diary, learned A.P.P. has stated that names of the petitioners have been included during investigation by the police on the basis of video footage.
In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Forbisganj (Simraha) P.S. Case No. 373 of 2015, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
