The petitioners apprehend their arrest in Laukahi P.S. Case No. 147 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioners and alleged that petitioner Satyanarayan Paswan @ Satya Narayan Paswan assaulted her husband with iron rod and Dharmlal Paswan also assaulted her.

Learned counsel for the petitioners submits that injuries found on the persons of Kapildev Paswan, the husband of the informant and Uma Devi are simple in nature caused by hard and blunt object. There is a counter version being Laukahi P.S. Case No. 146 of 2016 and the case of the petitioners is earlier in point

Considering the facts aforesaid and the fact that there is case and counter case and the informant and her husband got simple injuries, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Jhanjharpur, Madhubani in Laukahi P.S. Case No. 147 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
