====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner is in custody and seeks bail in connection with ByPass P. S. Case No.297 of 2019 registered for the offences punishable under Sections 363/ 365 of the I.P.C. and further added Sections 302, 201, 34 of the I.P.C. Petitioner is not named in the first information report, but in course of investigation, the informant claimed that some altercation had taken place between her and petitioner and after missing of her son, the villagers gave information to her that petitioner and others committed the murder of her son and threw the dead body in a pond. Furthermore, I find that some
Patna High Court CR. MISC. No.20580 of 2020(4) dt.14-10-2020 2/2 witnesses also claimed the above stated facts. Moreover, one blood stain jacket, which is said to be of petitioner, was recovered from the pond and except the aforesaid material as well as confessional statement of co-accused, there appears to be nothing against the petitioner, who is languishing in jail custody since 13.12.2019 and investigation against the petitioner has already been completed.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patnacity, Patna in connection with ByPass P. S. Case No.297 of 2019.
