The petitioners are languishing in custody since 21.02.2016 and 28.02.2016 respectively in connection with Sherghati P.S. Case No. 77 of 2016 (G.R. No. 275 of 2016) for the offences instituted under Sections 302 and 201/34 of the IPC. It is alleged that the petitioners killed the informant's aunt Nanhku Devi. The petitioners are the daughter-in-law and son respectively of the deceased.
It has been submitted on behalf of the petitioners that the petitioner no. 1 is in custody since 21.02.2016 and petitioner no. 2 is in custody since 28.02.2016 and the charge sheet has been
Patna High Court Cr.Misc. No.25771 of 2016 (3) dt.16-08-2016 2/2 submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. They have got no criminal antecedent. They have been named merely on the basis of suspicion. There is no eye witness to the alleged occurrence. There is no motive alleged against the petitioners. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, Gaya, in connection with Sherghati P.S. Case No. 77 of 2016 (G. R. No. 275 of 2016).
