JUSTICE SANJAY PRIYA ORAL ORDER 02-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kasim Bazar P.S. Case No. 153 of 2016 instituted for the offence under Sections 302/34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. In the written report it is alleged that total 15 named accused persons surrounded the son of the informant and made firing on account of which he died. The informant has alleged that murder of his son was planned by this petitioner along with one Sudarshan Mandal from Munger Jail. As such, from the written report itself it appears that petitioner was in jail on the date of occurrence.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.66149 of 2018 (2) dt.02-11-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 5th, Munger, in connection with Kasim Bazar P.S. Case No. 153 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
